Welcome to Sajmal Global Tech. By accessing our website at sajmalglobal.com, request proposal submissions, or hire vetted contract developers through our network, you agree to comply with and be bound by the following terms and conditions.

1. Services Rendered

Sajmal Global Tech provides custom software development, Next.js web application designs, React Native mobile apps, SEO, PPC digital marketing, and vetted remote contract freelance staffing services. The exact scope, milestones, pricing, and timelines of any engagement are defined in a separate Statement of Work (SOW) or master agreement.

2. Intellectual Property & Code Ownership

Unless specified otherwise in an executed contract:

Transfer of Ownership: Upon receipt of final payment for a milestone or project, all intellectual property rights, source code, designs, and databases created specifically for that project are transferred in full to the client.
Prior Intellectual Property: Sajmal Global Tech retains ownership of any pre-existing code libraries, developer utilities, or template designs utilized during construction.

3. Vetted Freelancer Placement

For clients engaging resources from our vetted freelance network:

Contracts & Oversight: Sajmal Global Tech manages developer contracts, compliance, workspace, and equipment setup in Kochi, Kerala.
Direct Integration: Placed developers integrate directly into client systems (e.g. Jira, GitHub, Slack) and operate under client timezone overlap.
Non-Solicitation: Clients agree not to directly hire, employ, or contract any placed developer outside of Sajmal Global Tech's platform for a period of 24 months following the termination of active engagement, unless written permission is granted.

4. Payments & Billing

Payment structures are determined by the chosen engagement model:

Hourly contracts are invoiced bi-weekly or monthly based on verified work timesheets.
Fixed-price milestone contracts require a commencement deposit and are billed upon delivery of specified milestones.
Late payments may result in immediate suspension of development, deployment support, or resource allocation.

5. Non-Disclosure & Confidentiality

We treat client intellectual property and project parameters with absolute confidentiality. All managers, developers, and writers sign legally binding Non-Disclosure Agreements (NDAs). We are happy to review and execute client-provided NDAs prior to disclosing sensitive project specifications.

6. Limitation of Liability

Sajmal Global Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising from or related to the deployment of software, delay in development, or execution of digital marketing campaigns.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kerala, India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in courts located in Ernakulam/Kochi, Kerala, India.

8. Modifications to Terms

Sajmal Global Tech reserves the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our services after updates become effective, you agree to be bound by the revised terms.
